These Terms of Use ("Terms") govern your access to and use of the digital community hosted on the Geneva app ("Community") managed by TeenProLifers, a 501(c)(4) nonprofit corporation based in Washington, D.C. By accessing or using the Community, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not access or use the Community.

1. Membership and Access

1.1 Eligibility: The Community is intended for use by pro-life Gen-Zers who share an interest in promoting a pro-life agenda. By accessing or using the Community, you represent and warrant that you are a member of the intended audience and that you meet the age and other eligibility requirements. Users must be between the ages of 13 and 26.

1.2 Account Registration: To access and participate in the Community, you may be required to create an account on the Geneva app. During the registration process, we collect personal information including your full name, birthdate, and phone number. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. TeenProLifers reserves the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

2. Community Guidelines

2.1 Compliance with Laws: Users of the Community agree to comply with all applicable local, state, national, and international laws and regulations. Users are responsible for their own actions and the content they post in the Community.

2.2 Respectful Conduct: Users shall engage in respectful and constructive discussions within the Community. Harassment, discrimination, hate speech, threats, or any other form of inappropriate behavior will not be tolerated.

2.3 Prohibited Content: Users shall not post or share any content that is illegal, defamatory, obscene, pornographic, or infringing upon the rights of others. Users shall not engage in any activity that could disrupt or impair the functionality or security of the Community.

2.4 Content Ownership: Users retain ownership of the content they post in the Community. By posting content, users grant TeenProLifers a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the operation of the Community and the promotion of TeenProLifers' mission.

3. Community Management

3.1 Community Director and Intern: The Community is managed by TeenProLifers' Community Director and Community Intern, who are responsible for overseeing the operation and administration of the Community. They have the authority to enforce these Terms, moderate content, and take necessary actions to maintain the Community's integrity.

3.2 Moderation and Removal: TeenProLifers reserves the right to moderate, monitor, and remove any content within the Community that violates these Terms, is deemed inappropriate, or disrupts the Community's purpose. Users may be notified or given a warning if their content is flagged or removed, and repeated violations may result in suspension or termination of access to the Community.

4. Intellectual Property

4.1 TeenProLifers' Rights: All intellectual property rights related to the Community, including but not limited to trademarks, logos, graphics, and other content provided by TeenProLifers, are the property of TeenProLifers or its licensors. Users shall not use, reproduce, or distribute TeenProLifers' intellectual property without explicit permission.

4.2 User-Generated Content: Users shall retain ownership of their own intellectual property rights in the content they post. By posting content in the Community, users grant other Community members a non-exclusive, royalty-free, worldwide license to access, use, reproduce, and display such content within the Community solely for personal, non-commercial purposes.

5. Collection and Use of Personal Information

5.1 Personal Information: In order to join the TeenProLifers Digital Community on the Geneva app, we collect the following personal information from users: full name, birthdate, and phone number. The birthdate is collected to enforce our age policy, as users must be between the ages of 13 and 26 to join.

5.2 Purpose of Collection: The collection of phone numbers, full names, and birthdates is for the purpose of verifying eligibility and maintaining a safe and age-appropriate community for pro-life Gen-Zers. Additionally, we collect phone numbers, full names, and emails for the purpose of contacting our supporters through text messages and newsletters, which may include updates, event announcements, relevant news, and information related to our mission and activities.

5.3 Privacy and Security: We are committed to protecting the privacy and security of your personal information. We will not disclose or sell your personal information to third parties without your consent, except as required by law or as outlined in our Privacy Policy.

5.4 Data Retention: We will retain your personal information for as long as necessary to fulfill the purposes outlined in these Terms or as required by applicable laws and regulations. You may request the deletion of your personal information by contacting us using the provided contact information in the Community.

5.5 Accuracy of Information: You are responsible for providing accurate and up-to-date personal information. If any changes occur, please update your account settings or notify us promptly to ensure the information we hold about you is accurate and current.

6. Disclaimers and Limitations of Liability

6.1 No Endorsement: TeenProLifers does not endorse or guarantee the accuracy, completeness, or reliability of any content posted within the Community. Users should exercise their own judgment when relying on information obtained from the Community.

6.2 Third-Party Websites: The Community may contain links to third-party websites or resources. TeenProLifers is not responsible for the availability, accuracy, or content of such external sites or resources. Users acknowledge and agree that TeenProLifers shall not be liable for any damages or losses arising from the use of or reliance on any such third-party websites or resources.

6.3 Disclaimer of Warranties: The Community is provided on an "as-is" and "as available" basis. TeenProLifers makes no warranties or representations of any kind, express or implied, regarding the operation or availability of the Community, or the accuracy, reliability, or suitability of the content within the Community. Users access and use the Community at their own risk.

6.4 Limitation of Liability: To the fullest extent permitted by applicable law, TeenProLifers, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with the use or inability to use the Community.

7. Modifications and Termination

7.1 Modifications: TeenProLifers reserves the right to modify or update these Terms at any time. Users will be notified of any material changes to these Terms, and continued use of the Community after the effective date of such changes constitutes acceptance of the modified Terms.

7.2 Termination: TeenProLifers may, at its sole discretion, suspend, terminate, or restrict access to the Community for any reason, including but not limited to a violation of these Terms or any applicable laws or regulations. In the event of termination, these Terms shall continue to apply to any content posted within the Community.

8. Governing Law and Jurisdiction

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Washington, D.C., without regard to its conflict of law principles.

8.2 Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Washington, D.C.

9. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

These Terms constitute the entire agreement between you and TeenProLifers regarding your access to and use of the TeenProLifers Digital Community on the Geneva app, superseding any prior agreements or understandings, whether oral or written, relating to the subject matter herein.

By accessing or using the TeenProLifers Digital Community on the Geneva app, you acknowledge that you have read, understood, and agreed to these Terms of Use, including the collection and use of personal information as described herein.
